Highlights-New pilot for Temporary foreign workers in Canada
Coming this September, the Recognized Employer Pilot (REP) is set to make things simpler and lighter for employers who regularly hire under the Temporary Foreign Workers (TFW) Program. If they have a history of playing by the program’s rules, they’re in luck.
Usually, most employers need something called a Labor Market Impact Assessment (LMIA) before they can hire a temporary foreign worker. This LMIA checks if there’s a genuine need for a foreign worker and if no Canadians or Permanent Residents can do the job. It also makes sure the job offer is real and that the employer follows the program’s requirements to safeguard workers.
With REP, eligible employers get longer-lasting LMIA approvals, up to 36 months, and an easier LMIA application process.
REP Rollout Details
REP’s introduction happens in two steps:
- Starting in September 2023, folks in the Primary Agriculture sector can apply for the 2024 season.
- From January 2024, it opens up for all other industries.
Applications for both stages are open until September 2024.
To jump into REP, employers need at least three thumbs-up LMIAs for the same job type in the last five years. These jobs should be from a list where there’s a shortage, as per the Canadian Occupational Projection System (COPS).
Eligible employers can apply through a special LMIA form that serves two purposes: getting recognized under REP and applying for an LMIA at the same time.
How REP Eligibility Works
To see if an employer qualifies for REP, the Employment and Social Development Canada (ESDC) looks at their history with the TFW Program. Even if they don’t get “recognized” status, they can still use the TFW Program, and ESDC will keep checking their LMIA requests.
The assessment also considers how often an employer uses the TFW Program for jobs mentioned in COPS and the Canada In-Demand Occupation List.
How to Apply for LMIA and REP
There are two ways:
OPTION 1: Use the LMIA Online Portal to fill and submit the application to ESDC online.
OPTION 2: If there’s a legit reason to avoid the Online Portal, employers can email a PDF application form to ESDC.
Why Consider REP
For employers who fit the bill, there are perks:
- A simplified process for future LMIA requests for jobs on the COPS list.
- Less back-and-forth with ESDC thanks to easier LMIA forms during REP, letting employers hire more foreign workers for real job offers.
- A Job Bank tag that shows they’re recognized, which could attract more interested workers.
Canada’s government says REP is just one of many improvements coming up for the TFW Program. So, more good stuff is on the way.
